Private individuals who have booked an apartment with a commercial landlord can in principle exercise their 14-day right of cancellation. However, this is subject to certain conditions.
Cancellation is not possible in the following cases:
- You have already moved into the corresponding apartment
- Your landlord is not commercial
- This is a company booking
- The concluded rental contract is an accommodation contract or it is a GTC.

The provisions of the Spanish General Consumer and Consumer Protection Act (derived from an EU directive) concerning distance contracts and contracts concluded outside business premises do not apply to rental for residential purposes (rental of residential premises), as they fall under the exception of Article 93(f) of the Spanish General Consumer and Consumer Protection Act.
At the end of this period, the landlord's general terms and conditions will apply or you will have the option of terminating your rental contract in an ordinary or extraordinary manner (fees may apply).
